Public Offer Agreement of SushiBoss Cafe-Store
General Provisions
1.1. This offer is an official proposal of the online store (cafe-store) “SushiBoss”, hereinafter referred to as the “Seller”, to conclude a дистанционный sales agreement (hereinafter — the “Agreement”) and publishes a Public Offer on the official website: https://sushiboss.com.ua/.
1.2. The moment of full and unconditional acceptance (acceptance) of the Seller’s offer is considered to be the fact of payment by the Buyer for the order under the terms and prices specified on the website.
Terms and Definitions
2.1. In this offer, the following terms have the following meanings:
* “Product” — dishes, drinks, disposable tableware, and products for preparing sushi and other Japanese cuisine dishes;
* “Online Store” — a tool for presenting or selling goods/services via electronic transactions;
* “Seller” — the company selling products on the website;
* “Buyer” — an individual who has entered into this Agreement;
* “Order” — selection of products made by the Buyer on the website.
Subject of the Agreement
3.1. The Seller undertakes to transfer the Product into the ownership of the Buyer, and the Buyer undertakes to pay for and accept the Product.
This Agreement regulates:
- selection of products;
- order placement;
- payment;
- processing and delivery.
Order Placement
4.1. The Buyer may place an order for any available product.
4.2. Any product can be ordered in any quantity.
4.3. If a product is unavailable, the Buyer will be informed.
4.4. The Buyer may replace or cancel the item/order.
Payment Terms
Non-cash payment via Interkassa
5.1. Payment is made after order confirmation via Interkassa.
5.2. If payment is not received, the order may be canceled.
Delivery Terms
6.1. Delivery is carried out to the address specified by the Buyer by a SushiBoss courier.
6.2. The Buyer receives documents (receipt) according to Ukrainian law.
Rights and Obligations
7.1. The Seller has the right to suspend services if the Buyer violates the Agreement.
7.2. The Buyer must pay for and receive the order.
7.3. The Buyer has the right to place orders and demand fulfillment.
Liability
8.1. The parties are liable according to Ukrainian law.
8.2. The Seller is not responsible for:
- product appearance changes;
- color differences due to screens;
- incorrect data provided by the Buyer;
- delays beyond control;
- illegal actions of the Buyer;
- transfer of personal access data.
8.3. The Buyer is responsible for any damage caused by their actions.
8.4. Force majeure releases parties from obligations.
8.5. Disputes are resolved through negotiations.
Other Terms
9.1. The Seller may amend this Agreement by publishing it on the website.
9.2. The online store is created for remote sales.
9.3. The Buyer consents to personal data processing.
9.4. Payment confirms acceptance of the Agreement.
9.5. Agreement date is defined by Ukrainian law.
9.6. Website usage is free.
9.7. Buyer data is confidential and used only for order processing.
Validity Period
10.1. The agreement is concluded upon acceptance.
10.2. It may be terminated before delivery with a refund.
10.3. It may be terminated unilaterally in case of violation.
